EULA - End User License Agreement

ELECTRONIC END USER LICENSE AGREEMENT
FOR winOKE

The product winOKE and all of it's files, from this point onward is refered to as this software.
Robert Smith from this point onward is/are refered to as the company

NOTICE TO USER:
BY INSTALLING THIS SOFTWARE YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.

This End User License Agreement accompanies this software and related materials such as manuals. The term "Software" also shall include any upgrades, modified versions or updates of the software licensed to you by the company. Please read this Agreement carefully. At the end, you will be asked to accept this agreement and continue to install or, if you do not wish to accept this Agreement, to decline this agreement, in which case you will not be able to use this software.

This software is shareware, this release of this software entitles you to 30 days free trial, during your unregistered period you are NOT permitted to use the program in public, it is purely for private evaluation purposes. After the 30 days of evaluation or if you decide you wish to use it in public you MUST register it. (To register it, click on the button marked "Register" from either the main menu or the "Your Trial Period" dialog that appears when this software starts.)

To use this software in any way with television broadcasting / the media, a special licence must to be obtained from the company.

Upon your acceptance of this Agreement, the company grants to you a nonexclusive license to use this software, provided that you agree to the following:

1. Copyright and Trademark Rights. This Software is owned by the company named above. This Agreement does not grant you any intellectual property rights on this software.

2. Restrictions. You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of this software. You may not alter or modify in any way the installer program or create a new installer for the Software.

3. No Warranty. This software is being supplied/delivered to you "AS IS" and the company makes no warranty as to its use or performance. The Company AND ITS SUPPLIERS DO NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THIS SOFTWARE OR DOCUMENTATION. IN NO EVENT WILL ROBERT SMITH and/or WINOKE LTD. OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS or LOST SAVINGS. Some states or jurisdictions do not allow the exclusion or limitation of incidental, consequential or special damages, or the exclusion of implied warranties or limitations on how long an implied warranty may last, so the above limitations may not apply to you.

4. This software includes an automatic bug reporting system to let the authors know of potential problems. It is your choice if you decide to use it. As part of the reporting process, details about the current state of your machine, settings, currently active winOKE windows etc will be collected and sent. By accepting this agreement you agree that this information may be sent. If you do not agree then you should not use this program.

5. If you would like to re-distribute winOKE and/or any of its accompanying files then the following MUST abide by the following:

A. winOKE MAY ONLY be distributed in the original installation SETUP program form unless otherwise arranged with the company.

B. winOKE May NOT be put on covermounted disk/CD or any electronic medium/internet site without prior consent from the company. (I don't mind it happening, but would like to know first.)

C. winOKE registration/unlocking codes may NOT be passed on to ANYONE...
